West Virginia residents aged 18 and up diagnosed with at least one qualifying medical condition may be eligible to apply for a WV medical card.
Caregiver
West Virginia’s medical marijuana law defines a caregiver as someone at least 21 years or older who has been approved to obtain medical marijuana products from a licensed dispensary and deliver them to a medical cannabis patient.
Can Minors Qualify?
Yes. However, for a patient under 18 to participate in the West Virginia medical marijuana program, they will need a caregiver to apply on their behalf.

Medical Marijuana Recommendation
Once approved, your WV medical marijuana doctor will submit your recommendation to the state so you can complete your application.
Proof of Identity
You will need a government-issued photo ID, such as a West Virginia driver’s license, state ID card, U.S. passport, or certified copy of your birth certificate with proof of residency.
Proof of West Virginia Residence
Acceptable proof of residence is anything that shows your current address, such as utility bills, bank statements, recent property tax statements, voter registration cards, and health insurance documents.

How to Renew Your Card
The process of renewing your medical card is similar to when you joined the West Virginia medical cannabis program initially. Here’s everything you need to know:
- Sign in to Leafwell or register as a renewal patient if you’re new to Leafwell.

Caregivers
Minor patients will require a parent or legal guardian as a caregiver.
Caregiver Requirements:
- Minimum 21 years old.
- Certain circumstances may allow someone under 21 years old to be a caregiver. The patient and caregiver will need to contact the program.
- A background check is required.
Caregiver Registration (State):
There are two parts to the caregiver registration process: the authorization form and the caregiver application.
- The caregiver or parent/legal guardian will apply after the patient has received approval from the Office of Medical Cannabis (OMC).
- Complete the Patient Authorization for Designation of Caregiver form.
- Your physician does not need to sign it. A notary must sign the form.
- Complete the Criminal Background Check Rights Acknowledgement form.

- Submit federal and state criminal history records (background check).
- There is a $50 fee. The bureau may waive or reduce the fee in cases of demonstrated financial hardship.
- Caregivers must also submit fingerprints for a criminal background check through IdentoGo.
- Submit the completed forms with the caregiver application.
Reciprocity
West Virginia does not currently accept out-of-state medical marijuana cards. The state could create reciprocity agreements with similarly regulated states to allow terminally ill cancer patients to purchase medical cannabis. No such arrangements have been made as of December 2023.

What do I need to know about applying online for my medical cannabis card in West Virginia?
- Register with Leafwell and speak to a West Virginia-licensed healthcare provider online. Consultations cost $109, and you'll only be charged if approved.
- Get approved. Your provider will submit your certification to the state.
- Register and log in to the West Virginia Office of Medical Cannabis licensing portal to complete your state application and pay a $50 application fee.
- Your application will be processed in 30-60 days. Once your application is approved, your digital medical card will be available to download from your state account.
How old do I have to be to apply for a medical cannabis card in West Virginia?
Can I be/have a caregiver for a medical marijuana patient in West Virginia?
- Minimum 21 years old
- Certain circumstances may allow for someone under 21 years old to be a caregiver. The patient and caregiver will need to contact the program.
- A background check is required.
- Caregivers may serve up to five (5) patients. Patients may have up to two (2) caregivers.
- $50 nonrefundable fee. The bureau may waive or reduce the fee in cases of demonstrated financial hardship.
- Complete the Patient Authorization for Designation of Caregiver form. The form must be notarized.
- Complete the Criminal Background Check Rights Acknowledgement form.
- The caregiver or parent/guardian will apply after the patient has received his/her approval from OMC.
- You will need to create an account with the West Virginia Medical Cannabis Portal by entering your email address and creating a password for the account. If you have an existing account, sign in and skip to step 7.
- Enter your registration information.
- Once you have entered the registration information and submitted it, you will receive an email from Complia with a link to verify your account. When you click on the link, you will be automatically directed back to the website.
- To request another verification email, please visit https://wvpublic.mycomplia.com/#!/resendVerifyAccountEmail.
- Once your account is verified, sign in to your account to start the application.
- Click on +Create New Application.
- Click on New Caregiver Registration and then click Create Application.
- Provide the requested information.
- Caregivers must submit a $50.00 processing fee for the application unless requesting a waiver based on financial hardship.
- You must upload a copy of the Patient Authorization for Designation of Caregiver and the Criminal Background Check Rights Acknowledgement forms as part of the application.
- You must also submit fingerprints for a criminal background check through IdentoGo.
How do I apply for the state program in West Virginia?
- Digital passport-style photo
- Valid photo ID (WV Driver's License, WV State ID, or Passport)
- Proof of West Virginia residency (Click here to view acceptable documentation)
- If requesting a waiver of the fee based on financial hardship (income below 200% of the federal poverty level), provide acceptable proof of income, such as W-2, recent pay stubs, proof of benefit eligibility, etc. Please do not send a payment if you are requesting a fee waiver. If the waiver is not granted, you will be notified to submit the fee at that time.
- Create a new user account with the Department of Health and Human Resources.
- Once your account has been created and verified, log in to Complia and click Create New Application.
- Click on New Patient Registration and then click Create Application.
- Once the application is created, complete all required information. Each application contains multiple tabs with required data fields, question responses, and document uploads.
- When you get to the Physician/Condition Information tab, choose Online – Electronic Certification and then click on the View Available Certifications green button.
- Select the physician certification and then click Update.
- Once you get to the Review tab, make sure all required items are completed and have a green check mark. Then, click Submit. A confirmation screen will appear with the Application ID number.
- Mail payment (check or money order payable to WV DHHR) to WV Office of Medical Cannabis, 350 Capitol Street, Suite 523, Charleston, WV 25301. The Application ID number and patient name must be in the memo line of the check or money order.
- You will be notified via email of the status of your application within 30-60 days.
